1. INTRODUCTION & ACCEPTANCE

These Terms & Conditions (“Terms”) govern all forms of access to, participation in, and engagement with the websites, digital platforms, programs, services, events, fellowships, honors, recognitions, donations, payments, communications, publications, and initiatives of the Indo-American (AMN) Health and Research Foundation (“Foundation,” “we,” “our,” or “us”).

By accessing, registering, applying, donating, making payment, attending events, or otherwise engaging with the Foundation in any manner, you irrevocably acknowledge, accept, and agree to be legally bound by these Terms, read together with the following policies, which form an integral part hereof:

  • Privacy Policy

  • Refund, Returns, Cancellation & Adjustment Policy

  • Fellowship & Recognition Regulations

  • Program-Specific Guidelines

  • RTI & Public Disclosure Framework

If you do not agree to these Terms, you must immediately discontinue all engagement with the Foundation.


2. LEGAL STATUS & NON-COMMERCIAL NATURE

The Foundation is a non-profit, mission-driven organization incorporated under Section 8 of the Companies Act, 2013 (India).

Accordingly:

  • No buyer–seller, consumer–service provider, or commercial contractual relationship is created

  • All payments constitute voluntary contributions, program fees, or administrative charges, and not consideration for goods or services

  • No payment guarantees any degree, license, employment, recognition, conferment, outcome, or entitlement

  • Participation is voluntary, evaluative, honorary, and non-commercial in nature


3. SCOPE OF ACTIVITIES

The Foundation undertakes, inter alia, the following non-commercial activities:

  • Nations’ Plenary Health & Research Summit (NPHRS)

  • Fellowship & Honors Programs

  • MARS 24/7 – Mental Assistance Response Service

  • Nova Hikari (光) Programs

  • Health, research, education, leadership, policy, and outreach initiatives

  • Conferences, ceremonies, workshops, forums, and publications

All activities are conducted strictly for charitable, educational, scientific, and public-interest purposes.


4. ELIGIBILITY, VERIFICATION & DISCRETION

Participation in any program or activity is subject to:

  • Prescribed eligibility criteria

  • Truthful, complete, and accurate disclosure of information

  • Government-issued identity verification, biometric attendance, KYC, compliance, and security checks

The Foundation reserves absolute, unilateral, and unfettered discretion to accept, reject, suspend, revoke, or modify participation at any stage, without obligation to assign reasons.


5. PAYMENTS, FEES & ABSOLUTE NON-REFUNDABILITY

5.1 Core Governing Principle

ALL PAYMENTS MADE TO THE FOUNDATION ARE STRICTLY, ABSOLUTELY, AND IRREVOCABLY NON-REFUNDABLE, including but not limited to:

  • Application, registration, processing, and evaluation fees

  • Fellowship, honors, CCS evaluation, and ceremony fees

  • Event, workshop, and conference fees

  • MARS 24/7 session fees

  • Nova Hikari (光) program fees

  • Donations, grants, sponsorships, and voluntary contributions

Once payment is made:

  • No refund, reversal, or adjustment shall be permitted

  • Non-attendance, partial attendance, dissatisfaction, personal constraints, visa or travel issues, illness, emergencies, or change of intent do not create refund rights

  • No chargeback, dispute, or consumer claim may be initiated without prior written approval

  • Non-refundability is a material and fundamental condition of engagement

5.2 Limited Technical Exception

Refunds may be considered solely in cases of duplicate payment or proven payment gateway error, if reported within 14 days, and approved entirely at the Foundation’s discretion.
Such approval shall not constitute a precedent.


6. NPHRS & FELLOWSHIP HONORS – GENERAL PRINCIPLES

  • Fellowship Honors are validation-based recognitions, not degrees, diplomas, or training programs

  • They do not constitute academic qualifications, professional licensure, or employment

  • Absence from any event does not create any entitlement, refund, or claim


7. FELLOWSHIP STATUS & CONFERMENT

7.1 Final Fellowship Status (Standard Rule)

Final Fellowship Status is ordinarily conferred only upon verified physical presence at an officially designated International NPHRS Fellowship Honors Ceremony, subject to complete compliance and verification.

7.2 Provisional Fellowship Honors

Provisional Fellowship Honors may be granted upon:

  • Attendance at a Regional Meeting or Foundation-approved alternate forum; or

  • Where the Foundation, in its sole discretion, is not fully satisfied with documentation or compliance

Provisional Honors:

  • Do not authorize use of Fellowship titles or suffixes

  • Do not reduce fees or create refund rights

7.3 Final Fellowship at Regional Meeting (Discretionary Clause)

Notwithstanding the standard requirement of International Ceremony attendance, the Foundation may, at its sole and absolute discretion, confer Final Fellowship Status at a Regional Meeting, provided the Foundation is fully satisfied that the participant:

a) Has fulfilled all eligibility, evaluation, and selection requirements;
b) Has completed all mandatory verification protocols, including government ID, biometric attendance, KYC, and compliance checks; and
c) Continues to demonstrate alignment with the Foundation’s values, ethics, governance standards, and mission.

Legal Safeguards:

  • The decision shall be final, conclusive, and binding

  • Determined strictly on a case-by-case basis

  • Subject to approval by the competent authority of the Foundation

  • Creates no right, entitlement, assurance, or precedent

  • Non-approval does not give rise to any refund, compensation, or claim

  • This clause does not dilute the absolute non-refundability policy


8. MARS 24/7 – MENTAL ASSISTANCE RESPONSE SERVICE

  • MARS is a non-emergency support service

  • It does not replace medical, psychiatric, or emergency care

  • Session fees are non-refundable once booked

  • Missed sessions or user-initiated cancellations are forfeited


9. NOVA HIKARI (光) PROGRAMS

Nova Hikari (光):

  • Is non-degree, non-licensing, and non-medical

  • Focuses on resilience, leadership, self-awareness, and holistic well-being

  • All fees are strictly non-refundable

  • Rescheduling or batch transfers are discretionary and do not create refund rights


10. MERCHANDISE, CERTIFICATES & MATERIALS

  • Returns are accepted only for damaged, defective, or incorrect items, reported within 7 days with proof

  • Non-returnable items include certificates, insignia, medals, customized items, and digital content


11. MISUSE, MISREPRESENTATION & FORFEITURE

Any benefit shall be immediately forfeited if a participant:

  • Misrepresents Provisional Honors as Final

  • Uses Fellowship titles or suffixes without authorization

  • Submits false, misleading, or forged documents

  • Violates ethical standards or the Code of Conduct

No refund or compensation shall arise.


12. PRIVACY, DATA & NO FINANCIAL ENTITLEMENT

Personal data is processed strictly in accordance with the Privacy Policy.
Data access, correction, or grievance mechanisms do not create any right to refund, compensation, or financial entitlement.


13. WAIVER, LIMITATION OF LIABILITY & INDEMNITY

  • Participation is entirely at the individual’s own risk

  • Foundation liability, if any, shall be limited strictly to the refundable amount (if applicable)

  • Participants agree to indemnify and hold harmless the Foundation against misuse, misrepresentation, or violations


14. FORCE MAJEURE

The Foundation shall not be liable for delay, modification, suspension, or cancellation due to events beyond reasonable control.


15. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
Exclusive jurisdiction shall lie with the courts at Bhopal, Madhya Pradesh, India.


16. AMENDMENTS & FINAL AUTHORITY

The Foundation reserves absolute, unilateral, and final authority to interpret, amend, and apply these Terms without prior notice.
Continued engagement constitutes acceptance of revised Terms.
