ARTICLE 1: LEGAL FOUNDATION, STATUTORY AUTHORITY & IRREVOCABLE ACCEPTANCE

1.1 Legal Binding and Contractual Nature These Terms & Conditions (“T&C”) constitute a valid, legally binding, and enforceable contract within the meaning of the Indian Contract Act, 1872. This instrument governs the entire Nations’ Plenary Health & Research Summit (NPHRS) Fellowship Framework, encompassing application, evaluation, conferment, use of titles, and post-conferment conduct.

1.2 Corporate Authority The NPHRS Fellowship Framework is conceived, administered, regulated, and enforced exclusively by the Indo-American (AMN) Health and Research Foundation (“the Foundation”), a Section 8 company incorporated under the Companies Act, 2013, Government of India. No other agency, partner, or affiliate possesses the authority to waive, amend, or interpret these provisions.

1.3 Constructive Acceptance By submitting an application, nomination, document, or payment, or by attending any event (Regional or International) or accepting any recognition under the NPHRS banner, you—in your individual capacity—unequivocally and irrevocably acknowledge that you have read, understood, and consented to be legally bound by these T&C. You further waive any future objection as to their enforceability or clarity.

1.4 Harmonious Construction These T&C shall be read in conjunction with the Foundation’s Privacy Policy, Refund Policy, Fellowship Regulations, Program Guidelines, and RTI Framework. In the event of a conflict, the provisions of this document shall prevail.


ARTICLE 2: FELLOWSHIP CATEGORIES & LEGAL NOMENCLATURE

The NPHRS Fellowship framework consists of the following three distinct honorary Fellowships:

  • F.I.A.H.S.H (Fellowship of Indo-American.Org Health Service Honors): Recognizing excellence in clinical service, healthcare delivery, leadership, and patient-centered care.

  • F.I.A.H.O.H (Fellowship of Indo-American.Org Health Outreach Honors): Recognizing contributions in community health, preventive care, public awareness, humanitarian service, and outreach initiatives.

  • F.I.A.H.R.H (Fellowship of Indo-American.Org Health Research Honors): Recognizing contributions in medical research, public health research, academic output, innovation, and evidence-based practice.

Statutory Clarification: Each Fellowship is strictly non-statutory, non-licensing, and non-academic. These designations do not derive authority from the National Medical Commission (NMC), UGC, or any statutory regulator and do not grant the holder any right to practice medicine or any clinical profession.


ARTICLE 3: LEGAL NATURE, DISCLAIMERS & EXCLUSION OF CONSUMER STATUS

3.1 Nature of Recognition NPHRS Fellowships are honorary validations of merit and professional standing. They are not academic degrees, professional licenses, or employment credentials.

3.2 No Service Relationship The Applicant acknowledges that the Foundation is not a “service provider” as defined under the Consumer Protection Act, 2019. The Fellowship is a recognition of merit, not a purchased commodity. Consequently, the Applicant expressly waives the applicability of consumer forum jurisdiction, acknowledging that Fellowship fees are voluntary contributions under Section 8 governance for the promotion of health and research.

3.3 Exclusion of Employment Fellowship conferment shall not be construed as the creation of an employer-employee, principal-agent, partnership, or fiduciary relationship.


ARTICLE 4: FELLOWSHIP STATUS & COMPREHENSIVE REFUND MATRICES

4.1 Governing Principle of Finality Fellowship status regulates recognition and representational privileges only. No Fellowship status—provisional or final—confers any financial, refund, compensation, or restitutionary right upon the participant.

4.2 Final Fellowship Status (The Definitive Path) * Conferment Criteria: Ordinarily conferred only upon verified physical presence at an officially designated International NPHRS Fellowship Honors Ceremony.

  • Representational Rights: Upon formal conferment, the individual is granted permanent authorization to use the applicable Fellowship suffix (F.I.A.H.S.H / F.I.A.H.O.H / F.I.A.H.R.H).

  • Refund Implication (Absolute Non-Refundability): Absence from the ceremony, irrespective of cause (including but not limited to visa rejection, illness, family emergency, or travel restrictions), shall not entitle the participant to any refund, fee adjustment, or damages.

4.3 Provisional Fellowship Honors (The Interim Path) * Conferment Criteria: Granted upon attendance at a Regional Meeting or a Foundation-approved alternate forum, or where the Foundation, in its sole discretion, is not fully satisfied with compliance requirements or the completeness and adequacy of documents submitted.

  • Limitations: Provisional status does not authorize the use of suffixes and creates no refund or compensation right.

4.4 Transition Path from Provisional to Final Status A participant holding Provisional Fellowship Honors may be considered for transition to Final Fellowship Status without payment of additional fees through:

  • Option 1: Attendance at the next International NPHRS Ceremony.

  • Option 2: Attendance at the next officially scheduled Regional Meeting designated for conferment.

  • Option 3 (Foundation Satisfaction Clause): At its absolute discretion, the Foundation may confer Final Status at a Regional Meeting if satisfied with the participant’s eligibility, KYC formalities, and continued alignment with Foundation values.


ARTICLE 5: EVENT CANCELLATION, POSTPONEMENT & LIABILITY

5.1 Foundation Discretion If an NPHRS event is cancelled or postponed, a partial refund, credit, or deferment may be offered at the Foundation’s sole discretion.

5.2 Exclusion of Incidental Costs The Foundation bears no liability for incidental expenses (airfare, hotel, visa fees). Participants arrange travel at their own financial risk.


ARTICLE 6: EVALUATION & THE CENTRALIZED CREDIT SCORE (CCS) SYSTEM

6.1 Mandatory Assessment Evaluation for all Fellowship categories shall be conducted exclusively through the proprietary Centralized Credit Score (CCS) Evaluation System, and all scores, weightages, assessments, and resultant determinations shall be final, binding, and non-appealable.

6.2 CCS Recognition Levels & Grading The following scoring tiers and grades are utilized to determine the level of honor conferred:

  • Gold Honors: 100–130 points | ★★★★★ (Outstanding)

  • Silver Honors: 70–99 points | ★★★★☆ (Excellent)

  • Bronze Honors: 50–69 points | ★★★☆☆ (Good)

  • Honorable Mention: 30–49 points | ★★☆☆☆ (Fair)

6.3 F.I.A.H.S.H (Health Service) Evaluation Matrix

  • Basic Qualifications (Mandatory): DM/MCH/MD/MS/DNB or equivalent.

  • Experience (10–20 pts): Minimum 3 years clinical experience.

  • Frontline Service (10–30 pts): Recognition of work in underserved or high-risk communities.

  • Excellence & Ethics: Verified record of patient care and clean disciplinary standing.

6.4 F.I.A.H.O.H (Health Outreach) Evaluation Matrix

  • Eligibility (10 pts): Indian Citizen or OCI working in India.

  • Experience (20 pts): Minimum 2 years in public health/outreach.

  • Impact (20 pts): Real-world applicability, cultural sensitivity, and reach of beneficiaries.

  • Alignment (10 pts): Synergy with National Health Mission (NHM) or Ayushman Bharat.

6.5 F.I.A.H.R.H (Health Research) Evaluation Matrix

  • Research Content (30 pts): Scientific rigor and validity of findings.

  • Authorship (30 pts): First or Corresponding Author in indexed journals (e.g., PubMed).

  • Innovation (20 pts): Translational potential and creative methodology.

  • Originality (20 pts): Preference for RCTs or large-scale cohort studies.


ARTICLE 7: MISREPRESENTATION, BREACH & FORFEITURE

Any misuse of the Fellowship title, false representation of credentials, or ethical breach shall result in the immediate and permanent revocation of Fellowship status without refund or compensation.


ARTICLE 8: DATA PROTECTION & PERMANENT RECORD RETENTION

Personal data is processed in accordance with the Digital Personal Data Protection Act, 2023. Fellowship records, including biometrics, are retained permanently for registry integrity and verification purposes.


ARTICLE 9: LIMITATION OF LIABILITY & INDEMNITY

Maximum liability of the Foundation, if any, shall be limited to ₹1 or the refundable amount (if specifically applicable), whichever is lower. The Foundation is not liable for Force Majeure events.


ARTICLE 10: GOVERNING LAW & EXCLUSIVE JURISDICTION

These T&C are governed by the laws of the Republic of India. Exclusive jurisdiction for any dispute arising out of this framework shall lie with the Courts at Bhopal, Madhya Pradesh.


ARTICLE 11: FINAL AUTHORITY & OFFICIAL COMMUNICATION

The Foundation retains absolute authority to interpret, amend, or enforce these T&C.
